Franchising

Franchising offers a compelling business model for both established companies seeking expansion and aspiring entrepreneurs.

I want to be a franchisor

A pilot franchise acts as a test case for your franchising model. It allows you to:

  1. Validate the financial viability of the franchise.
  2. Refine the know-how transfer. The pilot period provides valuable insights into effectively transferring your operational expertise to franchisees.
  3. Optimise your franchise offering. Based on pilot experiences, you can refine your franchise model to ensure its success in the marketplace.

During the pilot stage, there’s a collaborative flow of knowledge between you, the franchisor, and the pilot franchisee allowing you to gather feedback from the pilot franchisee on operational challenges and areas for improvement.

Hamilton Pratt will work with you to ensure you have the right type of agreement for the relevant development stage of your business.

In the world of franchising, your brand is your identity. Distinctive logos and words that represent your brand can be safeguarded through trademark registration. This ensures you have exclusive rights to use these elements within a specific territory.

Why Trademark Registration Matters:

Your franchise agreement will typically list the franchisor’s registered trademarks. Here’s why registration is crucial:

  • Territorial protection: Trademark rights are country-specific. A UK registration protects your brand in the UK only.
  • Strategic expansion: Consider protecting your trademarks in additional territories, especially anticipated future markets.

Our team of intellectual property specialists can handle the entire trademark registration process for you, on a fixed fee basis. This includes trademark classification research, conflict clearance and IPO application and management.

At Hamilton Pratt, we believe your franchise agreement should be unique to your business. That’s why we take a collaborative approach to crafting a document that reflects your needs.

Here’s how it works:

  1. Understanding your business: We’ll start by sending you a questionnaire (around 60 questions) to gain a deeper understanding of your business and proposed franchise model.
  2. Drafting and discussion: Based on your responses, we’ll create a discussion draft for your review. We’ll then schedule a meeting or call to discuss the draft in detail and answer any questions you may have.
  3. Refining your agreement: Through open communication, we’ll typically require two additional drafts to finalise your agreement, ensuring it accurately reflects your specific requirements.

We understand the importance of fixed fees and clear timelines. That’s why we offer fixed fees for agreement preparation.

Under normal circumstances, you can expect your final agreement within 6 weeks, taking into account time for your review and feedback. However, we are always flexible and will strive to meet your deadlines, even handling a bespoke franchise agreement in just 24 hours (our world record!).
